These Terms & Conditions (“Terms”) govern your access to and use of maisonpashme.com (the “Site”) and any quotes, orders, products, and services provided by Maison Pashme (“Maison Pashme,” “we,” “us,” or “our”). By accessing the Site, requesting a quote, or transacting with us, you (“you,” “Buyer,” or “user”) agree to these Terms. If you do not agree, please do not use the Site or place an order.
01 / About Us & Scope
Maison Pashme is an exporter and wholesale supplier of authentic Kashmiri handicrafts and products, including Pashmina shawls, silk carpets, papier-mâché, walnut wood handicrafts, saffron, and honey. Our business is primarily business-to-business (B2B), serving retailers, importers, distributors, interior brands, and wholesale buyers worldwide.
02 / Eligibility
To use the Site and transact with us, you must be at least 18 years old and able to form a legally binding contract. If you act on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms.
03 / Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable law or regulation;
- Infringe our intellectual-property rights or those of any third party;
- Copy, scrape, harvest, or reproduce content, product images, or data without our written permission;
- Introduce malware or attempt to gain unauthorized access to the Site or related systems; or
- Misrepresent your identity or impersonate any person or entity.
04 / Intellectual Property
All content on the Site — including text, graphics, product photography, designs, logos, and the “Maison Pashme” name and marks — is owned by or licensed to Maison Pashme and is protected by intellectual-property laws. You may not use, reproduce, distribute, or create derivative works from any of this content without our prior written consent.
05 / Product Information & Handcrafted Nature
Our products are handmade by skilled Kashmiri artisans. As a result, natural variations in color, pattern, grain, size, weight, and finish are inherent characteristics of handcrafted goods and are not defects. While we strive for accuracy, we do not warrant that product descriptions, images, dimensions, weights, or colors displayed on the Site are complete, current, or error-free.
06 / Quotes, Orders & Pricing
- Quotes and catalog prices are estimates for informational purposes and do not constitute binding offers. They are subject to change and to confirmation by us.
- Minimum order quantities (MOQs) and lead times may apply and will be communicated during the quotation process.
- An order becomes binding only when we confirm it in writing (for example, by proforma invoice or order confirmation).
- Unless stated otherwise, prices exclude taxes, duties, freight, insurance, and other charges.
07 / Payment
Payment terms, accepted methods, currency, and any required deposits are specified in the applicable quote or invoice. [Confirm default terms, e.g., prices in USD; advance deposit required for production orders; balance due before shipment.] Late or unpaid amounts may result in suspension or cancellation of orders and may accrue charges to the extent permitted by law.
08 / Custom, Private Label & OEM Orders
Custom, private-label, and OEM orders are produced to agreed specifications and typically require a deposit. Because such items are made to order, they are generally non-cancellable and non-refundable once production has begun, except for confirmed defects in workmanship as set out in these Terms.
09 / Shipping, Delivery & Title
Shipments are arranged according to the Incoterms® agreed in the order (for example, FOB, CIF, or DAP). Risk and title pass in accordance with the agreed Incoterm. Delivery dates are estimates and not guaranteed. Unless otherwise agreed, the Buyer is responsible for all import duties, taxes, customs clearance, and compliance with the laws and regulations of the destination country.
10 / Export Compliance & Sanctions
You agree to comply with all applicable export-control, trade, and economic-sanctions laws and regulations, including those of the United States and other relevant jurisdictions. You represent that you will not export, re-export, or divert our products to any embargoed country, restricted region, or prohibited party, or for any prohibited end use.
11 / Returns, Cancellations & Claims
Please inspect all goods promptly upon receipt. Claims for shortages, transit damage, or non-conformity must be submitted in writing within [X] days of delivery, with supporting photographs and documentation. Natural variations inherent to handcrafted products are not grounds for return. Approved remedies may include repair, replacement, or credit at our discretion. Custom and made-to-order items are non-returnable except for confirmed defects
12 / Warranties & Disclaimer
Except as expressly stated in these Terms or an applicable written agreement, products and the Site are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all other warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13 / Limitation of Liability
To the maximum extent permitted by applicable law, Maison Pashme and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Site, these Terms, or any order. To the extent liability cannot be excluded, our total aggregate liability will not exceed the amount you paid for the specific order giving rise to the claim.
14 / Indemnification
You agree to indemnify and hold harmless Maison Pashme and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Site or products, or your violation of any law or third-party right.
15 / Force Majeure
We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, civil unrest, government action, labor disputes, transportation or supply disruptions, or failures of telecommunications or utilities.
16 / Third-Party Links
The Site may contain links to third-party websites or resources that we do not control. We are not responsible for the availability, content, or practices of those third parties, and links do not imply our endorsement.
17 / Privacy
Your use of the Site and provision of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
18 / Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-laws principles, and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). These Terms, together with our Privacy Policy and any order confirmation or written agreement between us, constitute the entire agreement between you and Maison Pashme regarding their subject matter. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a business transfer. Nothing in these Terms creates an agency, partnership, or joint venture between the parties.
